By accessing our Website or placing an order, you agree to these Terms.
Nothing in these Terms is intended to limit or exclude any mandatory rights that you have under German or European Union consumer protection law.
1. Scope
These Terms apply to all visitors, users, and customers of hcmck.shop, including consumers purchasing products through our online Store.
A "consumer" means an individual acting primarily for purposes outside their trade, business, craft, or profession.
If any provision of these Terms conflicts with mandatory consumer protection law applicable to you, the mandatory legal provision will prevail.
2. Online Store
Our Store is operated using the Shopify ecommerce platform.
Shopify provides the technical ecommerce infrastructure that enables us to display and sell products and process customer orders.
Your purchase contract for products sold through hcmck.shop is concluded with Erik Hvid, unless expressly stated otherwise.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices, and other information displayed on the Website are accurate and up to date.
However, minor differences may occur between photographs displayed on a screen and the actual product, including differences caused by:
-
screen settings;
-
lighting;
-
photography;
-
manufacturing tolerances; or
-
product packaging updates.
Such differences do not affect any mandatory rights you may have if a product does not conform to the purchase contract.
Product availability is subject to stock.
We reserve the right to discontinue or modify products where permitted by law.
4. Prices
The price applicable to an order is the price displayed during the checkout process at the time the order is submitted.
Any applicable taxes, delivery charges, or other mandatory charges will be displayed to you before you place your order, where required.
We currently offer free standard shipping.
We reserve the right to change product prices at any time. Price changes do not affect orders for which a binding purchase contract has already been concluded.
If an obvious pricing or technical error occurs, we may contact you to correct the issue before accepting the order.
5. Placing an Order
To place an order, you must:
-
select the product you wish to purchase;
-
add the product to your shopping cart;
-
provide the required billing and delivery information;
-
select an available payment method;
-
review your order information; and
-
submit your order using the checkout button.
Before submitting your order, you are responsible for checking that the information provided is accurate.
Submitting an order constitutes an offer to purchase the products contained in your order.
An automatically generated order-receipt or order-confirmation message may acknowledge that we have received your order. Unless the message expressly states that your order has been accepted, such acknowledgement does not by itself constitute acceptance of your offer.
A binding purchase contract is concluded when we expressly accept your order or dispatch the goods, whichever occurs first.
6. Order Acceptance and Cancellation
We reserve the right to decline an order where there is a legitimate reason to do so, including where:
-
a product is unavailable;
-
information provided with the order is materially incomplete or incorrect;
-
there is an obvious pricing or technical error;
-
we cannot deliver to the address provided;
-
there is reasonable evidence of fraud or misuse; or
-
accepting the order would violate applicable law.
If we cannot fulfil an accepted order, we will contact you and provide any refund required under applicable law.
Nothing in this section limits your statutory cancellation or withdrawal rights.
7. Cash on Delivery (COD)
We offer Cash on Delivery (COD) as an available payment method.
When you select COD:
-
payment becomes due when the order is delivered;
-
you must provide accurate delivery and contact information;
-
you should ensure that you or an authorized recipient is available to receive the parcel; and
-
the applicable COD amount must be paid to the delivery provider in accordance with the instructions provided at delivery.
Where available, the exact payment methods accepted by the delivery provider may depend on the carrier.
If a COD delivery cannot be completed, the parcel may be returned to us.
Repeated fraudulent or abusive orders may result in reasonable restrictions on future orders where permitted by law.
Nothing in this section restricts your statutory consumer rights, including any applicable right of withdrawal.
8. Free Shipping
We currently provide free standard shipping for orders covered by our shipping offer.
Estimated delivery times shown on our Website are estimates unless a specific binding delivery date has expressly been agreed.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, transportation disruption, customs procedures where applicable, or other exceptional events.
Additional information about delivery is available in our Shipping Policy.
9. Delivery
Products will be delivered to the delivery address provided during checkout.
You are responsible for ensuring that your:
-
name;
-
street address;
-
postal code;
-
city;
-
telephone number; and
-
other required delivery information
are complete and accurate.
Please contact us promptly if you discover an error in your delivery information.
If your order has already been dispatched, it may not be possible to modify the delivery address.
Risk in goods passes to consumers in accordance with applicable mandatory consumer law.
10. Right of Withdrawal
Consumers may have a statutory right to withdraw from distance-selling contracts.
For consumers in Germany and other applicable EU jurisdictions, the standard statutory withdrawal period for goods is generally 14 days, subject to applicable legal requirements and exceptions.
Detailed information concerning:
-
the withdrawal period;
-
how to exercise the right of withdrawal;
-
return procedures;
-
refund procedures;
-
return costs; and
-
applicable exceptions
is contained in our Return and Refund Policy and statutory withdrawal information.
Nothing in these Terms limits your statutory right of withdrawal.
11. Returns and Refunds
Returns and refunds are handled in accordance with our Return and Refund Policy and applicable consumer law.
For Cash on Delivery orders, where a refund cannot reasonably be made through the original physical payment method, we may agree with you on an appropriate refund method, such as bank transfer.
Where legally required, such an alternative refund method will not result in additional fees for you solely because the alternative method is used.
Please contact:
for return and refund assistance.
12. Defective or Non-Conforming Products
Products must conform to the purchase contract and applicable legal requirements.
If a product is defective, damaged, incorrect, or otherwise fails to conform to the contract, you may have statutory rights including, depending on the circumstances and applicable law:
-
repair;
-
replacement;
-
price reduction;
-
termination of the contract; or
-
other remedies provided by law.
These statutory rights exist independently of any voluntary commercial warranty we may offer.
Nothing in these Terms excludes or restricts statutory rights relating to defective or non-conforming goods.
If you experience a problem with a product, contact:
Please provide your order number and a description of the issue. Photographs or videos may be requested where reasonably necessary to assess the problem.
13. Promotions and Discount Codes
From time to time, we may offer promotional prices or discount codes.
Unless otherwise stated:
-
discount codes must be entered during checkout;
-
discounts cannot be exchanged for cash;
-
promotions may be limited to certain products or periods;
-
multiple discount codes may not always be combined; and
-
promotional offers remain subject to mandatory consumer protection law.
Specific promotional terms displayed with an offer will apply to that promotion.
14. Accuracy of Billing and Account Information
You agree to provide current, complete, and accurate information when placing an order.
You agree to promptly update relevant information if necessary so that we can:
-
process your order;
-
contact you regarding your order; and
-
arrange successful delivery.
You must not intentionally provide false identities, fraudulent addresses, or other misleading information.
15. Acceptable Use of the Website
You may use our Website only for lawful purposes.
You must not:
-
use the Website for unlawful or fraudulent purposes;
-
attempt to interfere with Website security;
-
introduce viruses, malicious code, or harmful software;
-
attempt unauthorized access to our systems;
-
scrape or collect information through unauthorized automated means;
-
impersonate another person;
-
submit fraudulent orders;
-
interfere with another person's use of the Website; or
-
use our Website in violation of applicable law.
We may restrict access where reasonably necessary to protect the Website, our customers, or our legitimate interests.
16. Intellectual Property
Unless otherwise indicated, the content available through hcmck.shop, including:
-
text;
-
graphics;
-
page designs;
-
product presentation;
-
photographs;
-
icons;
-
logos;
-
videos; and
-
other original Website content
is owned by us, licensed to us, or otherwise used with authorization and may be protected by applicable intellectual property laws.
You may use the Website for personal and lawful shopping purposes.
You may not reproduce, distribute, sell, commercially exploit, or systematically copy protected Website content without authorization, except where permitted by applicable law.
17. Third-Party Services and Links
Our Website may contain links to third-party websites or use third-party services, including services necessary for ecommerce, delivery, analytics, or Website functionality.
Third-party websites operate independently from us.
We are not responsible for the content, availability, or practices of independent third-party websites, except where liability cannot legally be excluded.
You should review the applicable terms and privacy policies of third-party services before using them.
18. Privacy and Personal Data
We process personal data in accordance with our Privacy Policy and applicable data protection law.
Our Privacy Policy explains, among other things:
-
what information we collect;
-
why we process it;
-
how information may be shared;
-
how long information may be retained;
-
how cookies and similar technologies may be used; and
-
your rights regarding personal data.
For privacy-related questions, contact:
19. Website Availability
We aim to keep our Website available and functioning correctly.
However, uninterrupted or error-free access cannot always be guaranteed.
We may temporarily suspend or restrict Website availability where reasonably necessary for:
-
maintenance;
-
security;
-
technical updates;
-
system improvements; or
-
circumstances beyond our reasonable control.
This does not affect rights relating to purchase contracts that have already been concluded.
20. Limitation of Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms is intended to exclude or limit liability for:
-
death or personal injury caused by negligence where such liability cannot lawfully be excluded;
-
intentional misconduct;
-
gross negligence;
-
fraud or fraudulent misrepresentation;
-
mandatory product liability;
-
breach of mandatory consumer rights; or
-
any other liability that cannot legally be excluded or limited.
For consumers, any additional limitation of liability applies only to the extent permitted by mandatory applicable law.
21. Force Majeure and Events Outside Our Control
We will not be responsible for delays or failures caused by events outside our reasonable control to the extent permitted by applicable law.
Such events may include:
-
natural disasters;
-
extreme weather;
-
transport interruptions;
-
strikes;
-
governmental restrictions;
-
major telecommunications failures;
-
widespread network outages; or
-
other exceptional events beyond our reasonable control.
We will take reasonable steps to minimize the effects of such circumstances where possible.
Your mandatory statutory rights remain unaffected.
22. Changes to These Terms
We may update these Terms from time to time for future use of the Website, including to reflect:
-
changes to our business;
-
Website changes;
-
operational changes;
-
new features; or
-
changes in applicable law.
The version of the Terms applicable to a purchase is generally the version made available to you when you place that order, subject to mandatory law.
Material changes will not retroactively remove statutory rights relating to an already concluded purchase contract.
The current version will be published on hcmck.shop with an updated "Last Updated" date.
23. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
For consumers, any invalid provision will be replaced or interpreted in accordance with mandatory applicable law rather than in a manner that reduces statutory consumer rights.
24. Governing Law
These Terms and contracts concluded through our Store are governed by applicable law.
To the extent that a choice of law is legally permitted, Danish law may apply because the seller is established in Denmark.
However, where you are a consumer residing in Germany or another EU Member State, this choice of law does not deprive you of mandatory consumer protection rights granted by the laws that would otherwise apply in your country of habitual residence.
25. Consumer Rights
Nothing in these Terms is intended to waive, restrict, or exclude mandatory rights available to consumers under German or European Union law.
Where these Terms conflict with mandatory consumer protection legislation, the mandatory statutory provisions take precedence.
26. Entire Agreement
These Terms, together with the policies and information expressly incorporated into them, including where applicable our:
-
Return and Refund Policy;
-
Privacy Policy;
-
Shipping Policy; and
-
Legal Notice
form the contractual framework governing purchases through our Store, subject to applicable mandatory law.
